January 2014: A class-action lawsuit was filed against 23andMe, Inc. for allegedly falsely advertising its Personal Genome Service and Health Kit. Specifically, plaintiffs claim that the company represents that the Health Kit will provide consumers with information about their health – including “reports on over 240+ health conditions and traits” – without clinical data to support such claims. In addition, the complaint alleges that the company’s advertising of the Health Kit violates the Federal Food, Drug, and Cosmetic Act because the company did not obtain the necessary authorization from the FDA before marketing it. (Stanton et al v. 23andMe, Inc., Case No. 14-cv-00294, N. D. CA.).
