December 2021: The Court dismissed the case without prejudice.

August 2020: Plaintiffs filed an amended complaint adding allegations that the “whole grain” stamp on the front label is misleading when the product contains ingredients that are not whole grains.

November 2019: A class-action lawsuit was filed against Whole Foods Market Group for allegedly misleadingly listing “organic dehydrated cane juice solids” in the ingredients list for 365 Everyday Value Organic Oats & Flax Instant Oatmeal when, according to plaintiffs, the ingredient is actually sugar. (Warren et al. v. Whole Foods Market Group, Inc., Case No. 19-cv-6448, E.D.N.Y.)
