Atkins Nutritionals “Net Carbs” Claims

June 2020: The Court approved a settlement agreement that resolves the Smith, Colella, and Fernandez cases.

2018: Another class-action lawsuit was filed alleging that Atkins misleadingly markets the amount of carbs in products. (Smith et al. v. Atkins Nutritionals, Inc., Case No. 18-cv-4004, W.D. Mo.)

October 2017: A class-action lawsuit was filed against Atkins Nutritionals for allegedly deceptively marketing products as having low or zero “net carbs” when, according to plaintiffs, the company subtracts grams of sugar alcohol from the amount of carbs to arrive at the amount of “net carbs” in the product, despite the fact that sugar alcohol is a type of carbohydrate and impacts blood sugar. (Colella et al v. Atkins Nutritionals, Inc., Case No. 17-cv-5867, E. D.N.Y.)

August 2017: A class-action lawsuit was filed against Atkins Nutritionals for allegedly falsely marketing products as having low “net carbs” (which the company defines as carbohydrates that “significantly impact your blood sugar level and therefore are the only carbs you need to count when you do Atkins”) when the company does not include sugar alcohols in its calculation of carbohydrates even though sugar alcohols contribute to carbohydrates and impact blood sugar. (Fernandez et al. v. Atkins Nutritionals, Inc., Case No. 17-cv-1628, S.D. Cal.)
