Bags of Hershey’s Kisses

April 2017: This action was voluntarily dismissed, the reasons for which have not been disclosed. The named plaintiff’s claims were dismissed with prejudice.

September 2016: A class-action lawsuit was filed against The Hershey Company for allegedly deceptively packaging varieties of Hershey’s Kisses in the same size bag when they actually contain different amounts of chocolate. According to the complaint, the bag of Milk Chocolate Kisses has 12 ounces of chocolate while the bag of Milk Chocolate with Almonds Kisses has 11 ounces and the bag of Cookies ‘N’ Crème Kisses has 10.5 ounces. (Huppert et al v. The Hershey Company, Case No. 16-cv-7338, S. D. NY.)

When a complaint is dismissed with prejudice, it cannot be refiled.

You know when you buy a big bag of chips, and you’re all psyched for a feast, and then it turns out there are like, three chips in the bag? That bag is slack filled.
