Boxes of Chewy Red Hots Candy

August 2017: Ferrara Candy Co. filed a Notice of Appeal regarding the decision to remand the case to state court.

June 2017: A federal judge remanded the case to state court.

December 2016: A false advertising class-action lawsuit was filed against Ferrara Candy Co. in December 2016 (and transferred to federal court in January 2017). Specifically, the complaint alleges that the company deceptively packages its Chewy Red Hots candy using slack-filled cardboard boxes. According to the complaint, the boxes are “substantially empty.” (Waters et al v. Ferrara Candy Co., Case No. 17-cv-197, E. D. MO.)
