May 2019: The parties agreed to withdraw the appeal, the reasons for which have not been disclosed.

January 2019: The plaintiff filed a Notice of Appeal regarding the decision to dismiss this case.

December 2018: A federal judge dismissed all of the claims in this case concluding, among other things, that plaintiffs did not adequately allege that the products are unnatural.

2016: A false advertising class-action lawsuit was filed against Kraft Heinz Foods and Daisy Brand for allegedly misleadingly marketing Breakstone Sour Cream and Daisy Brand Sour Cream as natural when, according to plaintiffs, the products contain ingredients that are derived from unnatural, genetically-modified organisms (GMOs). This lawsuit was originally filed in August 2016 and amended in February 2017. (Newton et al v. Kraft Heinz Foods Company and Daisy Brand, LLC, Case No. 16-cv-4578, E. D. NY.)
