April 2018: A federal judge granted final approval of the settlement agreement.

October 2017: Plaintiffs moved for preliminary approval of a proposed settlement agreement. According to its terms, class members with proof of purchase may receive a cash refund of $5 for each purchase, and class members without proof of purchase may receive one $2 Burger King® gift card. Burger King also agreed to a permanent injunction prohibiting the restaurant from charging customers who use a coupon more money for Croissan’wich sandwiches.

May 2017: A class-action lawsuit was filed against Burger King for allegedly deceptively offering a free CROISSAN’WICH® (a sausage, egg, and cheese breakfast sandwich) with the purchase of one sandwich when, according to the plaintiffs, customers who use Burger King’s BOGO coupon are charged a higher price for the sandwich so they are not truly getting a “free” sandwich. (Anderson et al v. Burger King Corp., Case No. 17-cv-1204, D. MD.)
