“Don Fizzle” Flavored Tobacco Products

January 2017: This action was remanded to state court because the company did not make plausible allegations or provide enough evidence to support a finding of federal jurisdiction.

August 2016: This action was transferred to federal court. (Case No. 16-cv-1922, S. D. CA.)

2015: A false advertising class-action lawsuit against Haze Tobacco, LLC alleges that the company deceptively markets “Don Fizzle” flavored tobacco products by:

  • Falsely representing that the products contain “nicotine 0.05%” when, according to plaintiffs, they actually contain double that amount and
  • Misleadingly marketing the products as made in the USA when, according to the complaint, they are actually made in other countries.
