Don Francisco Brand Coffee

July 2016: This action was voluntarily dismissed with prejudice as to the named plaintiff and without prejudice as to the class members. The reasons for the dismissal have not been disclosed.

May 2016:
A class-action lawsuit was filed against F. Gaviña & Sons, Inc. for allegedly deceptively marketing Don Francisco brand coffee. According to the complaint, the marketing for flavors of Don Francisco’s Gourmet Coffee – such as Vanilla Nut and Cinnamon Hazelnut – suggests that the coffee is flavored with natural ingredients without adequately disclosing that the coffees contain artificial flavoring. (Ely et al v. F. Gaviña & Sons, Inc., Case No. 16-cv-2694, N. D. CA.)

When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
