October 2016: A federal judge preliminarily approved a settlement of this action. According to the settlement terms, the company agreed to make certain changes to the packaging for the eight protein products at issue for a period of five years. Specifically, the company agreed to use translucent containers with a window to allow consumers to view the contents, add the number of servings to the label, and state that the product is sold by weight. The settlement does not provide class members with monetary compensation. A final fairness hearing is scheduled for February 6, 2017.
October 2015: A class-action lawsuit was filed against Post Holdings, Inc. for allegedly deceptively packaging DYMATIZE Protein products, including ISO-100, Elite Whey Protein, Elite Casein, Elite Fusion 7, Elite XT, Pursuit RX Recovery Blend, Elite Gourmet, and Pursuit RX Whey Protein. According to the complaint, the containers for these products are opaque and contain more than 45% empty space. (Kline et al v. Post Holdings, Inc., Case No. 15-cv-2348, S. D. CA.)
