Equate Migraine

December 2013: This case was voluntarily dismissed without prejudice, the reasons for which have not been disclosed.

October 2013: A class-action lawsuit was filed against Walmart for allegedly falsely marketing Equate Extra Strength Headache Relief and Equate Migraine Relief. Specifically, the complaint alleges that the company falsely markets Equate Migraine as a “superior and more-potent drug for headache relief” when, according to the plaintiffs, both Equate Extra Strength Headache Relief and Equate Migraine Relief contain the same amount of the same ingredients. (Newsome et al v. Wal-Mart Stores, Inc., Case No. 13-cv-07714, S. D. NY.).

When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
