In February 2015, a federal judge dismissed a false advertising lawsuit against Clorox because the parties reached a settlement and agreed to dismiss the lawsuit. The complaint, which was originally filed in 2012, alleged that the company falsely markets Fresh Step cat litter containing carbon as more effective at eliminating odors than other cat litters and that cats “choose” Fresh Step cat litter over others when, in reality, the Fresh Step is not more effective at eliminating odors than other litters and cats do not “choose” Fresh Step over other cat litters. The terms of the settlement have not yet been disclosed. (In Re Clorox Consumer Litigation, Case No. 12-cv-00280, N. D. CA.).
