April 2015: Two class-action lawsuits were filed against Kind, LLC for allegedly misleadingly marketing four of its snack bars, specifically KIND Fruit & Nut Almond & Apricot, KIND Fruit & Nut Almond & Coconut, KIND Plus Peanut Butter Dark Chocolate + Protein, and KIND Plus Dark Chocolate Cherry Cashew + Antioxidants. According to the complaints, the company markets the snack bars as, among other things, “healthy,” being a “good source of fiber,” and as containing “no trans fat” without meeting the requirements to make such claims. A similar class-action lawsuit was filed against the company the same month, this time for allegedly falsely representing that several varieties of snack bars – including KIND Fruit & Nut Bars, KIND Plus Bars, KIND Nuts & Spices Bars, and KIND Healthy Grains® Bars – are “all natural” when they actually contain unnatural ingredients. The plaintiffs also claim that the company falsely represents that products – including KIND Fruit & Nut Almond & Apricot, KIND Fruit & Nut Almond & Coconut, KIND Plus Peanut Butter Dark Chocolate + Protein, and KIND Plus Dark Chocolate Cherry Cashew + Antioxidants – are healthy when they actually do not meet the FDA requirements to make such claims (i.e., the products contain unhealthy levels of saturated fat).
