KIND Snack Bars

August 2015: These actions were transferred to a New York court to be heard with other similar lawsuits. Click here to learn more about the case. (In Re KIND LLC “Healthy and All Natural” Litigation, MDL No. 15-cv-2645, S. D. NY.)

April 2015: Two class-action lawsuits were filed against Kind, LLC for allegedly misleadingly marketing four of its snack bars, specifically KIND Fruit & Nut Almond & Apricot, KIND Fruit & Nut Almond & Coconut, KIND Plus Peanut Butter Dark Chocolate + Protein, and KIND Plus Dark Chocolate Cherry Cashew + Antioxidants. According to the complaints, the company markets the snack bars as, among other things, “healthy,” being a “good source of fiber,” and as containing “no trans fat” without meeting the requirements to make such claims. A similar class-action lawsuit was filed against the company the same month, this time for allegedly falsely representing that several varieties of snack bars – including KIND Fruit & Nut Bars, KIND Plus Bars, KIND Nuts & Spices Bars, and KIND Healthy Grains® Bars – are “all natural” when they actually contain unnatural ingredients. The plaintiffs also claim that the company falsely represents that products – including KIND Fruit & Nut Almond & Apricot, KIND Fruit & Nut Almond & Coconut, KIND Plus Peanut Butter Dark Chocolate + Protein, and KIND Plus Dark Chocolate Cherry Cashew + Antioxidants – are healthy when they actually do not meet the FDA requirements to make such claims (i.e., the products contain unhealthy levels of saturated fat). (Cooper et al v. Kind LLC, Case No. 15-cv-1872, N. D. CA.)
