Kiss My Face Products

January 2014: This action was dismissed with prejudice as to the named plaintiff and without prejudice as to the class members. According to the Stipulation for Dismissal, the company no longer manufactures products marketed using the phrase “Obsessively Organic.”

May 2012: A class-action lawsuit filed against Kiss My Face, LLC for allegedly misrepresenting that a line of its products – which includes moisturizers, hand crèmes, shampoo, and toothpaste – is organic (using labels such as “obsessively organic”) when it’s not. (Dronkers et al v. Kiss My Face, LLC, Case No. 12-cv-01151, S. D. CA.).

When a complaint is dismissed with prejudice, it cannot be refiled.

When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
