April 2017: The appeal was dismissed for lack of jurisdiction. (Case No. 17-55135, 9th Cir.)
March 2017: Plaintiffs filed a Petition for a Writ of Mandamus that would reverse the district court’s January 2017 transfer order.
February 2017: Plaintiffs filed a Notice of Appeal regarding the January 2017 transfer order.
January 2017: This case was transferred to another California court in order to be consolidated with Fernandez v. Obesity Research Institute.
March 2016: A class-action lawsuit was filed against Obesity Research Institute and others for allegedly falsely advertising the weight-loss supplement Lipozene as clinically proven to help users lose weight without exercising or changing their diet. The complaint also alleges, among other things, that the marketing violates a 2005 Court Order that permanently prohibits Obesity Research Institute and others from making certain claims in the marketing for products. (Bozic et al v. Obesity Research Institute, Case No. 16-cv-733, S. D. CA.)
