Luigi’s Real Italian Ice

February 2018: This case was voluntarily dismissed without prejudice, the reasons for which have not been disclosed.

January 2018: A class-action lawsuit was filed against J&J Snack Foods for allegedly underfilling Luigi’s Real Italian Ice. Specifically, the complaint alleges that the cups advertised as containing six fluid ounces only contain an average of only 5.4- to 5.5-fluid ounces. (Orbach et al v. J&J Snack Foods Corp., Case No. 18-cv-321, S. D. NY.)

When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
