Nissan’s InTouch

May 2017: A federal judge preliminarily approved a settlement of this action. According to the settlement terms, class members may receive a $500 voucher to use toward the purchase or lease of a new Infiniti vehicle, or a cash award in the amount of $30, plus an additional $55 if they affirm that they downloaded the Infiniti InTouch App before April 17, 2017. A final fairness hearing is scheduled for September 11, 2017.

March 2015: A class-action lawsuit was filed against Nissan for allegedly advertising that the InTouch system in Infiniti Q50 automobiles provides access to several smartphone applications and functions – including email and calendars – when, in reality, the InTouch system was not immediately available and did not work as advertised. (Rafofsky et al v. Nissan North America, Inc., Case No. 15-cv-01848, C. D. CA.).
