July 2020: A federal judge dismissed the Harris case with prejudice concluding that the made with “real” cocoa representation was not misleading because the cookies are made with cocoa.

August 2019: The Harper case was voluntarily dismissed without prejudice, the reasons for which have not been disclosed.

April and May 2019: Multiple class-action lawsuits were filed against Mondelēz Global for allegedly falsely advertising on the front of product packaging that Oreo Cookies are made with real cocoa when, according to plaintiffs, the cookies contain cocoa processed with alkali. When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
