The Packaging of Body Fortress Products and Pure Protein Products

January 2017: After being transferred to a court in New York, this case was dismissed without prejudice because the parties reached a settlement agreement, the terms of which have not been disclosed.

August 2016: A class-action lawsuit was filed against NBTY, Inc. and United States Nutrition for allegedly deceptively packaging protein products – including various Body Fortress and Pure Protein products – in large, opaque containers with more than 37% empty space. (Gates et al v. NBTY, Inc. and United States Nutrition, Inc., Case No. 16-cv-2090, S. D. CA.)
