August 2020: A state court judge granted preliminary approval of a proposed settlement agreement. According to its terms, class members may receive a cash award in an amount that depends upon a variety of factors, including the number of claims filed and whether a claimant provides proof of purchase. 2017: A class-action lawsuit was filed against Apple for allegedly deceptively marketing Powerbeats headphones as “BUILT TO ENDURE” and the “BEST HEADPHONES FOR WORKING OUT” when, according to plaintiffs, the headphones stop retaining a charge after being used during exercise or light activity due to a defect. (Simmons et al v. Apple Inc., Case No. 17CV312251, California State Court – Santa Clara)
