Premium Select Medium Red Smoked Salmon Filets in Oil

February 2018: Plaintiffs moved for preliminary approval of a settlement agreement in which the company agreed to make changes to the product’s packaging and website. According to the settlement terms, the company agreed to change the phrase “Smoked Salmon” to “Smoke Flavored Salmon Filets,” remove the terms “premium” and “medium red,” and replace an image of the fish that is used in marketing with one that more fairly portrays a farm-raised Coho Salmon. The company also agreed to modify the website so that it no longer says that the product is “lightly smoked.” A preliminary approval hearing is scheduled for March 12, 2018.

December 2017: A class-action lawsuit was filed against Bumble Bee Foods for allegedly deceptively marketing Premium Select Medium Red Smoked Salmon Filets in Oil as being high-quality, wild-caught salmon when, according to the complaint, the fish is low-quality, farm-raised salmon. In addition, plaintiffs claim the company misleadingly markets the fish as being smoked salmon when the salmon is unsmoked and the smoke flavor is added. (Rodriguez et al v.
