Primitive Survivors

October 2019: Plaintiffs filed an amended complaint bringing similar allegations. The case was then transferred from state court to federal court and later voluntarily dismissed without prejudice, the reasons for which have not been disclosed. (Case No. 19-cv-1943, S.D. Cal.)

August 2019: A class-action lawsuit was filed against Primitive Survivors for allegedly failing to disclose that consumers who respond to “risk-free” or “free” offers – such as offers for a free headlamp for completing an online survey – will be automatically enrolled in the continuous service subscription program Survivors Club resulting in consumers being charged without their consent. (Siela et al v. Superior Global Marketing Inc. d/b/a Primitive Survivors, Case No. 37-2019-00040992, California State Court – San Diego)

When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.
