Various Kind Snack Bars

In June 2015, the plaintiffs voluntarily dismissed a false advertising class-action lawsuit against KIND, LLC. The complaint, which was originally filed in April 2015 and transferred to federal court in May 2015, alleged, among other things, that the company made various misleading representations about Kind bars (such as KIND Fruit & Nut Almond & Apricot, KIND Fruit & Nut Almond & Coconut, KIND Plus Peanut Butter Dark Chocolate + Protein, and KIND Plus Dark Chocolate Cherry Cashew + Antioxidants), including:

  • Misrepresenting the nutrient content of several Kind bars;
  • Misrepresenting that several of the Kind bars are “low fat;” and
  • Failing to adequately disclose information required by Florida state law.

The lawsuit was dismissed without prejudice, meaning that it can be refiled. The terms of the dismissal have not yet been disclosed. (Molina et al v. KIND, LLC, Case No. 15-cv-1098, M. D. FL.)
