February 2017: A federal judge preliminarily approved a settlement of this action. According to the settlement terms, class members may receive $6 for each product purchased. Class members with proof of purchase may receive a refund for a maximum of 25 products while class members without proof of purchase may receive refunds for a maximum of five products. Though the company had already revised the product labels and deleted “Made in USA” representations from its website, it agreed, as part of this settlement, to continue to comply with the California’s Made in USA law. October 2016: A class-action lawsuit was filed against Vital Nutrients for allegedly deceptively labeling dietary supplements and over-the-counter pharmaceutical products – including Vitamin D3 supplements – as “Made in the U.S.A.” when they actually contain foreign ingredients. (Maxin et al v. RHG & Company, Inc., Case No. 16-cv-2625, S. D. CA.)
